Terms & Conditions

Please read the Terms and Conditions carefully before placing an order. The Terms and Conditions determine the business relationship between Eclectic Boogaloo and you, our Customer. By using Our website or by purchasing from us, you agree to be bound by them.

We are: Eclectic Boogaloo, a company registered in Australia under ABN 17583974910.

Our address is: 37 Capella Crescent, Moorabbin, Victoria, 3189. Australia.

You are: a visitor to Our website, our Customer.

We sell products and services across various distinct categories, each with its own Terms & Conditions.

Categories are indicated in the Terms & Conditions explicitly.  Any Terms or Conditions with-out an indication of specific categories, or stated as General, indicate that they apply to all categories.

Definition of Categories.

• UPHOLSTERY COURSES & CLUB - courses, workshops or tours run by, sold by, or collaborated with Eclectic Boogaloo
• UPHOLSTERY TOOLS & SUPPLIES - tools or supplies sold by Eclectic Boogaloo (excluding items covered in Upholstery & Drapery Fabrics)
• UPHOLSTERY & DRAPERY FABRICS - fabrics or leathers sold by Eclectic Boogaloo typically for use as the outer covering of Upholstery, Cushions or Windows.
• FURNITURE & BULKY ITEMS - any furniture; including but not limited to chairs, sofas, bedheads, bench seats, large cushions or supplies that are unable to be delivered using standard packaging by Australia Post
• GIFT CARDS - electronic or physical gift cards issued by Eclectic Boogaloo, for the purposes of redemption on products & services offered by Eclectic Boogaloo

Please read the category-specific sections carefully before placing your order, as terms differ meaningfully between categories.

GENERAL

No person under the age of 18 may purchase Goods or Services.  We look forward to seeing you again when you are over 18 years of age.

This agreement contains the entire agreement between Eclectic Boogaloo and you, our Customer and as such supersedes all previous agreements and understandings between each parties.

If you use our website in any way and make an order on behalf of another person you warrant that you have full authority to do so and you accept personal responsibility for every act or omission by you.

Eclectic Boogaloo reserves the right to update the Terms and Conditions set out herein, without notice.  The terms that apply to you are those posted on Our website on the day you order Goods or Services.

The price of Goods or Services may be changed by us at any time.  We will never change a price so as to affect the price charged to you at the time you buy those Goods or Services.

In the future, if you buy Goods or Services from us under any arrangements which does not involve your payment via Our Website; these terms still apply so far as they can be applied.

We do not sell the Goods in all Countries.  We may refuse to deliver the Goods if you live in a country we do not serve.

We reserve the right to charge a fair rental value for storage of Goods that belong to you, that have not been collected within a reasonable time frame.  This includes furniture that has been delivered to our warehouse to store temporarily either prior to works, or after works completion, where the works have been unable to start due to payment not being made, or customer decisions relating to the works have not been provided within a reasonable time frame.

UPHOLSTERY COURSES & CLUB

Upholstery Course or Club participants must be 16 years of age or older.

Full payment is required upon booking.  Booking online is not guaranteed unless we have received payment for the course or workbench and we have sent you a receipt.

Upholstery Course or Club bookings are not transferable unless approved in writing by Eclectic Boogaloo.

We reserve the right to reschedule or cancel class if the minimum number of students booked in the class has not been reached, in which case we will offer booked students the choice of a refund, or an offer to reschedule.

Upholstery Course or Club members participate in our Workshops, Events or Workbench bookings at their own risk.  Eclectic Boogaloo is not responsible for a participant’s personal injury.

Upholstery Course or Club members are required to follow Government mandates as stipulated from time to time.  This may include health orders such as being fully vaccinated for COVID-19, social distancing, checking-in and wearing face coverings.

GIFT CARDS

Entitles the electronic gift card (gift card) holder to apply the full value of the gift voucher towards a selected Goods, Services or Course offer by Eclectic Boogaloo.

• You can use the gift card value towards the cost of any Eclectic Boogaloo Goods, Services or Courses.
• Courses are run subject to demand.
• Vouchers cannot be exchanged for cash.
• Refunds are not given for Gift Cards.
• Gift Cards are valid for 36 months from date of issue.
• Gift Cards will not be extended past the expiry date.
• If using the Gift Card for courses, book early, places are limited due to the hands-on teaching style in all our classes.

You are responsible for the use and safety of your Gift Card. You are liable for all transactions on your Gift Card, except to the extent to which there has been fraud or negligence by us or by any of our employees.

UPHOLSTERY & DRAPERY FABRICS

Fabric orders are subject to minimum order quantities as set by individual suppliers. Minimums will be clearly stated on the product listing. We are unable to cut below the supplier's minimum quantity.

Fabric colours displayed on our website are representative only. Due to variations in monitor calibration, dye lots, and print runs, actual colours may differ from those shown. We strongly recommend ordering a physical sample before committing to a full fabric order. We accept no liability for colour variation between screen representations and delivered product.

Pattern repeats and fabric widths are provided in good faith based on supplier specifications and may be subject to slight variation.

International shipping of fabric products may be available upon request. However, some fabrics from certain suppliers cannot be shipped internationally due to licensing agreements, territorial distribution restrictions, or supplier policy. In such cases, we will notify you promptly and offer a full refund or alternative product recommendation.

BUSINESS DAYS

Orders are processed on Business Days only. A Business Day is defined as Monday to Friday, excluding Australian public holidays (Federal and State/Territory public holidays applicable to our location).

Orders placed after 12:00 pm AEST/AEDT on a Business Day, or on a weekend or public holiday, will be treated as received on the next Business Day.

ORDER CONFIRMATION

When you place an Order for Goods with us, we will email you confirmation of that Order.  Order acceptance and formation of a contract occurs when we despatch your goods or, for fabric orders, when your order has been placed with the relevant supplier.

All orders are subject to acceptance and availability.  We strive to keep the product listings up to date but occasionally an item listed may become unavailable or delayed.   If an Item you have ordered is unavailable, we will contact you by email, within 48 hours (as per business days definition), to offer you:

a)    A full refund; or

b)    Suitable alternatives; or

c)    Place the item on backorder.  Backorder means you will receive your item when it becomes available again.

In the case where the item is a one-of-a-kind, a full refund will be offered.

We reserve the right to decline or cancel any order at our discretion; including in the event of:

a)    Pricing errors or product unavailability

b)    Suspected fraudulent activity; or

c)    Payment not being successfully received

We acknowledge that our Customers may want to inspect our furniture before placing an order.  Please email hello@eclecticboogaloo.com.au or call ahead of time, to arrange an appointment to inspect the furniture at our Moorabbin warehouse.

GENERAL

Delivery timeframes are estimates provided by our carrier partners and are not guaranteed.  Some products may have an additional lead time prior to dispatch. Typical domestic delivery times once dispatched are:

• Metro areas: 2–5 Business Days (standard)
• Regional & remote areas: 5–10 Business Days (standard)

We use reputable carrier services. Once your order is dispatched, a tracking number will be provided via email where available. We are not responsible for delays caused by the carrier, weather events, or circumstances beyond our control.

Shipping costs are calculated at checkout based on the weight, dimensions, and destination of your order. Free
shipping thresholds may be offered from time to time and will be displayed on our website.

UPHOLSTERY TOOLS & SUPPLIES

Some upholstery supplies are noted as Bulky Items on the website. Bulky Items are considered as Furniture & Bulky Items under these terms & conditions.

UPHOLSTERY & DRAPERY FABRICS

Upholstery and Drapery Fabrics sold on our website are typically not held as stock on our premises. All fabric orders are placed directly with our authorised supplier partners on your behalf following receipt and confirmation of your order.

By placing a fabric order you acknowledge that our ability to fulfil your order is subject to the availability, lead times, and terms of the respective supplier. Supplier details, stock availability, and minimum order quantities may change without notice.

Lead Time refers to the time taken from Order confirmation to Dispatch.  Fabric lead times vary by supplier and product. Indicative lead times are:

• In-stock supplier items: 3–10 Business Days from order confirmation to dispatch from supplier.
• Back-ordered, Indent or made-to-order items: 4–16 weeks, or as advised at time of ordering.

Where we advise you of the estimated lead time at the time of order confirmation. These are estimates only and may be affected by supplier production schedules, import delays, or circumstances beyond our or the supplier's control. We will endeavour to communicate any significant delays to you as soon as we become aware of them.

Samples are available for many of our Upholstery & Drapery Fabrics.  These samples may be dispatched by Eclectic Boogaloo or directly by our authorised suppliers, and hence may be dispatched in multiple packages for same Order.

Samples typically do not have delivery tracking information.

FURNITURE & BULKY ITEMS

Due to the size, weight, and fragile nature of furniture and other bulky items, a shipping quote is required before these orders can be completed and despatched. The online checkout may capture your order and payment details, however dispatch will not occur until a shipping quote has been accepted by you.

We will contact you within 5 Business Days of your order to provide a shipping quote. The quote will be based on the item dimensions, weight, and your delivery address. If you do not accept the quoted shipping cost within 5 Business Days of it being provided, we reserve the right to cancel your order and issue a full refund.

Furniture and Bulky Item delivery may be carried out by Eclectic Boogaloo or third-party freight specialists. Delivery to your door (ground floor, reasonable access) is included in the quoted shipping cost unless otherwise stated. The following conditions apply:

• White-glove, room-of-choice, or assembly services may be available at additional cost — please enquire at the time of ordering.
• You must ensure safe access is available for the delivery team and any required equipment (e.g. stair access, narrow hallways).
• If delivery cannot be completed due to access issues, a redelivery fee may apply.
• Delivery timeframes for furniture are estimates and may vary; we will endeavour to provide tracking information where available.

IN STORE COLLECTION

Where a collection option is offered, the following conditions apply:

• Collections are available during our stated business hours on Business Days only unless otherwise agreed in writing
• You will receive a notification (email or SMS) when your order is ready for collection. Please do not attend for collection until you have received this notification.
• Upholstery tools and supplies are generally ready for collection within 1 Business Day of confirmed payment.
• Fabric orders may be collected once received from the supplier. Lead times apply.
• Furniture and bulky items may be available for collection from our premises by prior arrangement — please contact us before placing an order if you wish to collect a furniture item.
• Uncollected orders held for more than 14 days after notification may be returned to stock. A storage fee may apply for furniture items held after 7 days.
• Valid photo identification matching the order name may be required at collection.

INTERNATIONAL SHIPPING

International shipping is available upon request for selected products. Please contact us before placing an international order to confirm availability and obtain a shipping quote. The following conditions apply to all international orders:

• International orders are subject to a formal shipping quote, which must be accepted prior to despatch.
• The Customer is responsible for all import duties, taxes, customs clearance fees, and any other charges imposed by the destination country. We have no control over and accept no liability for such charges.
• Certain fabric products cannot be shipped internationally due to supplier licensing agreements and territorial restrictions. We will advise you of any restrictions prior to accepting payment.
• Furniture and bulky items are generally not available for international shipping due to freight complexity. Please enquire for specific circumstances.
• International delivery timeframes are estimates only and may be subject to delays caused by customs, carrier schedules, or other factors outside our control.
• We are not liable for any loss, damage, or delay to international shipments once goods have been handed to the carrier.

GENERAL

Our returns policy is in addition to, and does not exclude or restrict, your rights under the Australian Consumer Law as contained in the Competition and Consumer Act 2010 (Cth) ('ACL'). If a product is found to have a major failure as defined by the ACL, you are entitled to your choice of repair, replacement, or refund. For minor failures, we will provide a remedy within a reasonable time.

We do not accept returns or exchanges for change of mind, except where otherwise required by law. Please choose carefully.

For faulty or incorrectly supplied products, please contact us within 14 days of receipt.  We will assess the claim and, where valid, offer a repair, replacement, or refund at our discretion and in accordance with the ACL. Items must be returned in their original condition and packaging. Return shipping costs for faulty items will be covered by us.

Items returned due to customer error (e.g. incorrect product ordered) may be accepted at our sole discretion, subject to a restocking fee of up to 20%, and the customer bears return shipping costs. Items must be unused, in original packaging, and returned within 14 days.

VINTAGE GOODS

We offer a range of Vintage, Antique and Second Hand goods.  These goods are described in terms of genuineness, quality, quantity, origin, originality, age, period, style, features, design influences, materials used, provenance ( if any ), general condition, size and value. These are expressions of opinion only based on our knowledge, expertise and experience however should not necessarily be accepted as fact. We may describe these goods as in excellent or very good condition however always take into account considerations  commensurate with the considerable age, materials used and the reasonable use an item may have experienced over its existence. As many items are organic (timber, leather and or fabric) we never suggest an item is perfect. 

We highly recommend that you organise an inspection, or request additional pictures prior to purchase.

We will provide a description of the works carried out, or to be carried out for goods referred to as Restored.  Restored items are still likely to show imperfections on organic materials commensurate with age.

Our liability will be limited, to the extent that applicable laws allow, to the value of the purchase.

UPHOLSTERY & DRAPERY FABRICS

Fabric returns are subject to strict conditions, consistent with the policies of our supplier partners. Please read the following carefully before placing a fabric order:

• All goods received must be checked prior to cutting / manufacturing to ensure correct fabric, colour, dyelot and quantity has been ordered and further ensure the goods received are suitable for the application
• No returns or refunds once fabric has been cut from the roll. This is industry-standard policy applied by all our fabric suppliers and is non-negotiable.
• Full-roll purchases may be eligible for return subject to the individual supplier's return policy. We will advise you of the applicable supplier policy upon request prior to ordering.
• Fabrics with defects or weaving faults must be reported to us within 5 Business Days of receipt with photographic evidence. Claims notified after this period may not be accepted.
• The international industry standard for acceptable flaws in roll stock is 5 flaws per 50 meters of fabric; this standard is used in Eclectic Boogaloo's determination of fabric faults
• Minor natural variations in texture, weave, and colour inherent to the fabric type are not considered defects.
• We do not accept returns for fabrics ordered on the basis of screen colour representation only (we strongly recommend ordering a sample).
• Made-to-order or custom cut fabrics cannot be returned unless faulty.

Where a valid claim is upheld for a faulty fabric, we will work with the relevant supplier to arrange a replacement, credit, or refund. The outcome is subject to the supplier's determination, and we will advocate on your behalf.

FURNITURE & BULKY ITEMS

It is your obligation to inspect furniture and bulky items on delivery. For claims arising from transit damage, we require:

• Notation of damage on the carrier's delivery documentation at time of delivery.
• Written notification to us within 48 hours, including photographic evidence of the damage.

For manufacturing defects, please contact us within 7 days of receipt with photographic evidence. We will arrange assessment and, where the defect is confirmed, provide a remedy in accordance
with the ACL.

Furniture and bulky items returns for reasons other than fault or damage in transit are at our sole discretion and may incur return freight costs charged to the customer. Furniture must be in original, unused condition in original packaging.

UPHOLSTERY COURSES

If you can not attend an Upholstery Course, you must give us at least one week’s notice prior to the commencement of the Workshop.

• Cancellations made after this date will result in a partial refund of 50%.
• Reschedule requests made after this date will be treated as cancellations and hence will result in a partial refund of 50%, with a the new course booked at full price
• You will not be entitled to a refund or reschedule if the cancellation or reschedule request has been made within 24 hours of course commencement.
• We have no obligation to offer a make-up class if you happen to miss a class.  We can offer you a 20% discount to re-book another class.
• Cancellations made more than a week before the commencement of the Workshop will be entitled to a full refund. Please apply for a refund in writing via email to jen@eclecticboogaloo.com.au
• Reschedule requests made more than a week before the commencement of the Workshop will be offered a place in the next course and must be requested in writing via email to jen@eclecticboogaloo.com.au
• You will be entitled to a full refund or rescheduled course date free of charge if Eclectic Boogaloo cancels a Workshop under a force majeure event (inclusive of COVID-19)
• Otherwise, you will be entitled to a full refund if Eclectic Boogaloo cancels a Workshop for other reasons and an offer of a 10% discount to re-book another class.
• You will not be entitled to a refund if you do not comply with COVID-19 policies or Government mandated health orders in effect at the time of the Workshop.

UPHOLSTERY CLUB

If you can not attend an Upholstery Club Workbench booking, please give us at least 24 hour’s notice prior to the commencement of the booking.

• You will not be entitled to a refund if the cancellation has been made within 24 hours of the booking commencement.
• You will not be entitled to reschedule a workbench booking within 24 hours of the booking commencement.
• Cancellations made more than 24 hours before the commencement of the booking will be entitled to a full refund. Please apply for a refund in writing via email to hello@eclecticboogaloo.com.au
• You will be entitled to a full refund or rescheduled booking date free of charge if Eclectic Boogaloo cancels a booking under a force majeure event (inclusive of COVID-19)
• Otherwise, you will be entitled to a full refund if Eclectic Boogaloo cancels a Booking for other reasons and an offer of a 10% discount to re-book another workbench.
• Time to time, Eclectic Boogaloo may offer additional promotions in relation to the Upholstery Club that have limitations to cancellations and refunds.  The Terms and Conditions of these limitations will be available in the PROMOTIONS section.
• Upholstery Club Packages are non refundable.
• Upholstery Club Packages are valid for three years from date of purchase.

REFUND PROCESSING

Approved refunds will be processed to the original payment method (same-source) within 5–15 Business Days of us receiving and assessing the returned Goods. We are not responsible for delays in bank processing.

For refund methods that are not same-source, we will request proof of payment details and identification prior to processing the refund. We reserve the right to refuse payment methods that have a high-fraud risk.

Price of the Goods and Services are listed in Australian Dollars (AUD) and may include a Goods and Services Tax (GST) of 10%.  Online prices may be subject to change without notice.  If a change of price has occurred since the Order was made, we will not despatch the Goods until you have confirmed that you wish to continue with your order at the new price.

The Price of the Goods does not include Delivery costs.  Delivery Costs will be outlined to you upon checkout before payment is requested.  Quotes for Delivery costs for bulky items and furniture will only be provided upon request by contacting hello@eclecticboogaloo.com.au. 

Bank charges by the receiving bank on payments to us will be borne by us.  All other charges relating to payment in a currency other than the Australian Dollar will be borne by you.

For Orders made outside of Australia, please contact your local customs or other relevant authorities directly.  Any charges, taxes or duties incurred on the Order, after arrival in your country, will be borne by you and is your responsibility.  The value of all items in the Order will be declared, in keeping with Australian Export Regulations.

If we owe you money (for refunds, or any other reason), we will credit your credit or debit card as soon as reasonably practicable but in any event no later than 15 days from the date when we accept that repayment is due.

The Summer Slayers Upholstery Club Package offer, allows the purchaser of any Upholstery Club package during December 2023 to select a free occasional chair from Eclectic Boogaloo’s website:

• Available for Upholstery Club Packages purchase between 14th December 2024 and 31st of December 2024
• The free chair offer is only available once per Customer
• Only chairs listed under the “OCCASIONAL CHAIRS” or “DINING CHAIRS” category of the “SUPPLIES” website page is valid for this promotion
• Chairs are of varying condition, and are available As Found condition, but of a condition that makes it suitable for restoration in the Upholstery Club
• Upholstery Club Packages are non-refundable

The Cushion Launch offer, allows the purchaser of any Cushion Services to receive a 10% discount:

• Available for Cushion Services that commence the quotation process prior to the 1st of July 2023 where the customer makes mention of this offer prior to the 1st of July 2023
• Cushion Services are defined as any custom cushion sewing, cushion inserts, private cushion consultations and fabric purchases to be used as part of the cushion services.
• This offer excludes any Sewing or Upholstery Courses or Fabric House Tours
• This offer excludes cushions that are part of other upholstery works, such as for chairs, sofas or midcentury armchairs.
• This offer excludes postage & handling
• This offer can not be used in conjunction with any other offer or in addition to any discount (such as trade discount)

Upholstery and Drapery Fabric Promotions are offered from time to time:

• Where advised, free shipping is provided when the total order value is above the stated amount.  This offer is only available for the stated Product Category, even when the Order is placed in conjunction with Goods of a different Product Category.
• Where advertised, Volume Discounts are offered on certain Upholstery and Drapery Fabrics.  The Volume is measured individually for each of the Goods and the discount applied individually on each of the Goods.

Many of the items listed on our Website are one-of-a-kind, hand made products.  Due to the nature of being hand made, we can not guarantee that the items will be uniform and match each other every time.  Irregularities in the hand stitched images and flecks on the materials used are a consequence of hand made products.

Eclectic Boogaloo lists many items that are Vintage or Antique.  As such, minor imperfections may occur in keeping with the nature and age of the second hand product.

Goods may be sold to you with Care Instructions.  Please read and follow these instructions as Eclectic Boogaloo will not repair for free, replace or offer refunds for any Goods that are damaged through misuse and failing to follow the Care Instructions.

We strive to display the products as accurately as possible on Our website.  However, due to the monitor of your computer device, there is no guarantee that the colour on display on Our Website will match exactly to the colour of the product on delivery.

The law differs from one country to another.  This paragraph applies so far as the applicable law allows.

All the conditions, warranties or other terms implied by the law of any county other than the Commonwealth of Australia are excluded from this agreement to the extent permitted by law.

We, our Content Suppliers, may make improvements or changes to Our Website, the Content, or to any of the Goods or Services, at any time without advanced warning.

You are advised that Content may include technical inaccuracies or typographical errors.  If you find any such errors, we would be grateful if you bring this to our immediate attention.

We give no warranty and make no representation, express or implied as to:

• The quality of the Goods;
• Any implied warranty or condition as to merchantability or fitness of the Goods for a particular purpose;
• The correspondence of the Goods with any description;
• The adequacy or appropriateness of the Goods for your purpose;
• The truth of any Content on Our Website;
• Non-infringement of any right.

We are not liable in any circumstances for special, indirect or consequential loss or any damages whatsoever resulting from loss of use, loss of data or loss of revenues or profits, whether in an action of contract, negligence or otherwise, arising out of or in connection with your use of Our Website or the purchase of Goods or Services.

Except in the case of liability for personal injury or death, our liability under this contract is limited, to the maximum permitted by law, to the value of the Goods or Services you have purchased.

You agree to indemnify us against all costs, claims and expense arising directly or indirectly from:

• Your failure to comply with the law of any country;
• Your breach of this agreement;
• Any act, neglect or default by any agent, employee, licensee or customer of yours;
• A contractual claim arising from your use of the Goods;
• A breach of the intellectual property rights of any person.

We will defend the intellectual property rights in connection with our Goods or Services and Our Website, including copyright in the Content whether provided by us or by any other content provider (including copyright in text, graphics, logos, icons, images, audio clips, digital downloads, data, and software).

Except as set out below, you may not copy, modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the Content, in whole or part.

You may not use our name or logos or trademarks or any other Content on any website of yours or that of any other person.

Subject to the other terms of this agreement, you may download or copy Content only for your own personal use, provided that you maintain all copyright and other notices contained in it.  You may not store electronically any significant portion of any Content.
